Schopedia Website Terms and Conditions

1. Acceptance of Terms

Welcome to Schopedia ("we," "our," "us"). By accessing or using our website located at www.schopedia.net (the "Site"), registering an account, or purchasing any of our digital products (e.g., ebooks, videos, templates, courses) or services ("Products"), you ("you," "your," "User") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, you are prohibited from using the Site and must discontinue use immediately.

2. Account Registration

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. Products and Services

  • Digital Products: All Products sold on this Site are digital in nature and delivered electronically via download or access through a user account. No physical goods will be shipped.
  • License Grant: Upon successful payment, Schopedia grants you a limited, non-exclusive, non-transferable, and revocable license to use the purchased Product for your personal or internal business use. You may not reproduce, redistribute, resell, or publicly display the Product without our express written permission.
  • Membership/Subscription: If you purchase a subscription, it will automatically renew at the end of each billing cycle (e.g., monthly or annually) until you cancel. You can cancel your subscription at any time through your account settings, but you will not receive a refund for the current billing period.

4. Fees and Payment

  • Currency: All fees for our Products are displayed in United States Dollars (USD) or Zambian Kwacha (ZMW). We may use a third-party payment processor to bill you.
  • Taxes: You are responsible for any taxes, including Value Added Tax (VAT) or other levies, applicable to your purchase based on your location. For Zambian customers, Zambian VAT will be applied where required by law.
  • Refund Policy: Due to the digital and instantly accessible nature of our Products, all sales are final, and refunds are not typically provided. We may, at our sole discretion, issue a refund in exceptional circumstances, in accordance with applicable consumer law.

 

5. User Conduct and Restrictions

You agree not to:

  • Use the Site or Products for any illegal purpose.
  • Share your login credentials to allow others to access paid Products.
  • Reverse engineer, decompile, or otherwise attempt to discover the source code of any software on our Site.
  • Upload or transmit any viruses or malicious code.

6. Intellectual Property

All content on the Schopedia Site, including but not limited to text, graphics, logos, images, videos, course materials, and software, is the property of Schopedia or its content suppliers and is protected by international copyright and intellectual property laws. The "Schopedia" name and logo are our trademarks.

7. Privacy

Your privacy is important to us. Our Privacy Policy, which explains how we collect, use, and protect your personal information, is incorporated into these Terms by reference. By using the Site, you consent to the practices described in our Privacy Policy.

8. Disclaimer of Warranties and Limitation of Liability

  • "As Is" Basis: The Site and Products are provided on an "as is" and "as available" basis without any warranties of any kind.
  • Limitation of Liability: To the fullest extent permitted by applicable law (including the Zambian Consumer Protection Act), Schopedia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the Site or Products.

9. Governing Law and Dispute Resolution

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of Zambia, without regard to its conflict of law principles.
  • Dispute Resolution: Any dispute arising from these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiations. If the dispute cannot be resolved, it shall be submitted to the exclusive jurisdiction of the courts located in Lusaka, Zambia.

10. International Use

We control and operate the Site from Zambia. We make no representation that the Site or Products are appropriate or available for use in other locations. If you access the Site from outside Zambia, you are responsible for compliance with local laws.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of changes by posting the new Terms on the Site and updating the "Last Updated" date. Your continued use of the Site after any changes constitutes your acceptance of the new Terms.
